This Privacy Policy explains how Excellent Face Pty Ltd (ACN 89 669 708 641) and its related entities and trusts (BOOIE Beauty or our or we or us) collect, store, use, disclose and manage your personal information.

We are bound by our obligations under the Australian Privacy Principles (APPs), which are contained in the Privacy Act 1988 (Cth) (Privacy Act). We understand the importance of, and are committed to, protecting your personal information. 

BOOIE Beauty is in the business of selling cosmetics (Services). Personal information may be collected by BOOIE Beauty in the provision of our Services.

Personal information may be collected by BOOIE Beauty in connection with our website, social media accounts, applications (including mobile applications), software, WIFI networks and other technological means (including your device ID, geo-location information, IP address) (Online Platforms), as well as in connection with any direct communication between you and BOOIE Beauty.

Please take a moment to read this Privacy Policy as it explains how we manage your personal information that may be collected via our Online Platforms and in providing our Services. It also explains our obligations and your rights in respect of our dealings with your personal information.

By continuing to use the Online Platforms and the Services, you consent to BOOIE Beauty using your personal information in accordance with this Privacy Policy.

1. HOW WE COLLECT YOUR PERSONAL INFORMATION

We will collect and hold your personal information in a fair and lawful manner. Where it is reasonably practical to do so, we will collect your personal information directly from you. We may collect the personal information you directly give us through some of the following means:

  • when you make an inquiry or order in relation to our Services through our website located at www.booie.com 
  • in administering and performing any contracts with service providers;
  • when you contact us via telephone or email;
  • when you submit a dispute or complaint in relation to the provision of any of our Services;
  • through any Online Platforms provided by us;
  • while conducting customer satisfaction and market research surveys;
  • when you apply for a job with us;
  • when administering any of our Services; and/or
  • as otherwise required to manage our business.

However, in certain cases we may collect personal information from publicly available sources and third parties, such as suppliers, recruitment agencies, contractors, and business partners.

Personal information is defined in the Privacy Act as information or an opinion about you, whether it is true or not, which identifies you or from which your identity is reasonably identifiable.

We may collect personal information that allows us to identify who you are and share any other personal information that may be required for us to provide the Services and facilitate our dealings with you. 

The types of personal information we may collect includes:

  • Identification information - We may collect personal details allowing us to identify who you are such as your name, date of birth and gender; ;
  • Contact information - We may collect information such as your email address, phone number, third-party user names, residential, business and postal address and other information that allows us to contact you; 
  • Financial information - We may collect financial information such as your bank or credit card details used to transact with us and other information that allows us to transact with you and/or provide you with our Services; and
  • Statistical information - We may collect behavioral and statistical information about you in connection with the Services and/or the Online Platforms. This may include information collected from your device such as your device ID, geo-location information, IP address, browsing information and any personal information that you may provide directly or indirectly to us via Online Platforms.

We only collect sensitive information about you with your consent, or otherwise in accordance with the Privacy Act.

Where you do not wish to provide us with your personal information, we may not be able to provide you with our Services.

3. PURPOSES FOR HANDLING YOUR PERSONAL INFORMATION

As a general rule, we only process personal information for purposes that would be considered relevant and reasonable in the circumstances.

4. PROTECTION OF PERSONAL INFORMATION

We will hold personal information as either secure physical records, electronically on our intranet system or in cloud storage.

We maintain appropriate physical, procedural and technical security for our offices and information storage facilities so as to prevent any loss, misuse, unauthorised access, disclosure, or modification of personal information. This also applies to disposal of personal information. 

We further protect personal information by restricting access to personal information to only those who need access to the personal information to do their job. Physical, electronic and managerial procedures have been employed to safeguard the security and integrity of your personal information.

We will destroy or de-identify personal information once it is no longer needed for a valid purpose or required to be kept by law.

5. MINORS

While we have no intention of collecting any personal information from individuals under the age of 18, we are unable to check whether a website visitor is of a certain age. 

If we collect personal information of an individual under the age of 18 and their parent or guardian does not wish us to retain this personal information, please contact us using the contact details below. We will then make sure that this information is deleted.

6. DIRECT MARKETING

Like most businesses, marketing is important to our continued success. We believe we have a unique range of products and services that we provide to our customers. We therefore like to stay in touch with customers and let them know about new opportunities. We may provide you with information about new services and promotions either from us, or from third parties which may be of interest to you.

We will not disclose your personal information to third parties for marketing purposes without your consent.

You may opt out at any time if you no longer wish to receive commercial messages from us. You can make this request by unsubscribing or contacting us.

We may also collect personal information from you when you use or access our Online Platforms. This may be done through use of web analytics tools, ‘cookies’ or other similar tracking technologies that allow us to track and analyse your usage. Cookies are small files that store information on your computer, mobile phone or other device and enable and allow the creator of the cookie to identify when you visit different websites. Cookies may be used to serve relevant ads to website visitors through third party services such as Google AdWords]. These ads may appear on our Online Platforms or other websites you visit. If you do not wish for information to be stored as a cookie, you can disable cookies in your web browser. 

8. ACCESSING AND CORRECTING YOUR PERSONAL INFORMATION

You may contact us to request access to the personal information that we hold about you and/or to make corrections to that information, at any time. If we refuse access, we will provide you with a written notice stating our reasons for refusing access. We may seek to recover from you reasonable costs incurred for providing you with access to any of the personal information about you held by us.

We are not obliged to correct any of your personal information if we do not agree that it requires correction and may refuse to do so. If we refuse a correction request, we will provide you with a written notice stating our reasons for refusing.

We will respond to all requests for access to or correction of personal information within a reasonable time.

9. OVERSEAS TRANSFERS OF PERSONAL INFORMATION

As at the date of this Privacy Policy, we are not likely to disclose personal information to other overseas recipients. If in future we do propose to disclose personal information overseas, we will do so in compliance with the requirements of the Privacy Act. We will, where practicable, advise you of the countries in which any overseas recipients are likely to be located.

By providing your personal information to us, you consent to us disclosing your personal information to any such overseas recipients for purposes necessary or useful in the course of operating our business and agree that APP 8.1 will not apply to such disclosures. For the avoidance of doubt, in the event that an overseas recipient breaches the APPs, that entity will not be bound by, and you will not be able seek redress under, the Privacy Act.
